1. Acceptance of Terms

Welcome to PuzzleEscape Room. By accessing our website, booking our escape room experiences, or using our services, you agree to be bound by these Terms of Service. Please read these terms carefully before making a booking or participating in any of our escape room activities. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you and PuzzleEscape Room, located at 19 Brain Rd, Adelaide SA 5000, Australia. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Booking and Reservations

2.1 Booking Process

All bookings must be made in advance through our official website, by phone at +61 8 7122 9903, or via email at [email protected]. Walk-in bookings are subject to availability and cannot be guaranteed. When making a booking, you must provide accurate and complete information, including the number of participants, preferred date and time, and contact details.

2.2 Payment Terms

Payment is required at the time of booking to secure your reservation. We accept major credit cards, debit cards, and other payment methods as displayed on our website. All prices are in Australian Dollars (AUD) and include applicable taxes unless otherwise stated.

2.3 Cancellation and Refund Policy

• Cancellations made more than 48 hours before the scheduled booking time will receive a full refund.
• Cancellations made between 24-48 hours before the scheduled time will receive a 50% refund.
• Cancellations made less than 24 hours before the scheduled time are non-refundable.
• No-shows will not be eligible for any refund or rescheduling.
• We reserve the right to cancel bookings due to technical issues, safety concerns, or force majeure events, in which case a full refund will be provided.

3. Participant Requirements

3.1 Age Restrictions

Participants must be at least 10 years old to enter our escape rooms. Children under 16 must be accompanied by an adult (18+) at all times. Some rooms may have higher age restrictions due to content or difficulty level, which will be clearly indicated at the time of booking.

3.2 Health and Safety Requirements

Participants must be in reasonable physical and mental health to participate in our escape room experiences. Our rooms may involve physical activities such as bending, reaching, crawling, and standing for extended periods. If you have any medical conditions, physical limitations, or concerns about your ability to participate safely, please inform our staff before your session begins.

The following conditions may prevent participation or require special accommodations:

• Severe claustrophobia or anxiety disorders
• Heart conditions or high blood pressure
• Pregnancy (especially in the later stages)
• Mobility impairments that may limit movement in confined spaces
• Epilepsy or sensitivity to strobe lights or flashing effects

4. Rules of Conduct

4.1 General Behavior

All participants are expected to behave respectfully and responsibly during their visit. PuzzleEscape Room reserves the right to remove any participant who:

• Behaves in a disruptive, aggressive, or inappropriate manner
• Appears to be under the influence of alcohol or drugs
• Damages property or equipment intentionally or through negligence
• Refuses to follow staff instructions or safety guidelines
• Engages in any illegal activity on the premises

4.2 Room Rules

During your escape room experience, you must:

• Handle all props, puzzles, and equipment with care
• Not use excessive force on locks, doors, or any other elements
• Not climb on furniture or fixtures unless specifically instructed
• Not write on, mark, or deface any surfaces or objects
• Follow all instructions provided by the game master
• Exit the room immediately if an emergency alarm sounds

5. Liability and Indemnification

5.1 Assumption of Risk

By participating in our escape room experiences, you acknowledge that there are inherent risks associated with the activity. You voluntarily assume all risks related to your participation, including but not limited to physical injury, property damage, or emotional distress. PuzzleEscape Room has taken reasonable precautions to ensure the safety of all participants, but we cannot guarantee that injuries will not occur.

5.2 Limitation of Liability

To the fullest extent permitted by law, PuzzleEscape Room, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services or participation in our escape room experiences. This includes, but is not limited to, damages for personal injury, property damage, lost profits, or loss of data.

5.3 Indemnification

You agree to indemnify, defend, and hold harmless PuzzleEscape Room and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these Terms of Service, your participation in our escape room experiences, or your violation of any rights of another person or entity.

6. Photography and Video Recording

For safety and intellectual property protection, photography and video recording inside the escape rooms are strictly prohibited unless explicitly authorized by PuzzleEscape Room staff. We may take photographs or videos during your visit for promotional purposes. By participating, you grant us permission to use such media in our marketing materials, website, and social media channels. If you do not wish to be photographed or recorded, please inform our staff before your session begins.

7. Intellectual Property

All content on our website and within our escape rooms, including but not limited to text, graphics, logos, images, audio clips, video clips, puzzles, storylines, and software, is the property of PuzzleEscape Room or its content suppliers and is protected by Australian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without our express written permission.

8. Privacy and Data Protection

Your privacy is important to us. We collect and process personal information in accordance with our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. 9. Force Majeure

PuzzleEscape Room shall not be liable for any failure or delay in performance of our obligations under these Terms of Service due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

10. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of South Australia and the Commonwealth of Australia, without regard to its conflict of law provisions. Any dispute arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of South Australia.

Before initiating any legal proceedings, the parties agree to attempt to resolve any disputes through good faith negotiations. If a resolution cannot be reached within 30 days, either party may pursue legal remedies.

11. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published on our website, constitute the entire agreement between you and PuzzleEscape Room regarding your use of our services and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.
